The High Court on Thursday rejected a writ petition filed by Mostafizur Rahman Chowdhury, Awami League candidate from Chattogram-16 (Banshkhali) constituency in the January 7 elections, challenging the Election Commission (EC) decision on cancellation of his candidature on the polls day.
The High Court bench of Justice Abu Taher Md Saifur Rahman and Justice Md Bashir Ullah passed the order after hearing the petition.
Barrister Khan Mohammad Shameem Aziz appeared in the court hearing on behalf of the EC, while lawyer Asma Jalil appeared for Mostafizur Rahman.
Earlier on January 7, the Election Commission cancelled the candidacy of ruling Awami League candidate and current lawmaker from Chattogram-16 (Banshkhali) Mostafizur Rahman Chowdhury. The action was taken because he threatened law enforcement officials, said EC Secretary Jahangir Alam.
According to the Returning Officer, if EC cancels the candidacy of a candidate, the election shall be held among the other contesting candidates of the concerned constituency.
