Cabinet approves draft Public Procurement Ordinance

The Cabinet has granted both in-principle and final approval to the draft of the ‘Public Procurement (Amendment) Ordinance, 2026.’

The government took this decision to safeguard the interests of domestic industries and enhance competition in public procurement activities.

Final approval for the ordinance was granted during the 21st Cabinet meeting held on Sunday (September 20) at the Secretariat in the capital.

Prime Minister Tarique Rahman presided over the meeting. These details were disclosed in a press release issued by the Cabinet Division. Cabinet members and secretaries of the relevant ministries were present at the meeting.

The notification states that amending the Public Procurement Act will foster greater competition in procurement activities while safeguarding the interests of domestic industries. Simultaneously, provisions regarding the administration and management of procurement contracts will be expanded, and the procedures for open tendering methods will be modernized.

To facilitate a more sustainable procurement system, a provision for ratio-based evaluation of criteria has been introduced for the procurement of goods, works, and physical services.

Under this method-which mirrors the internationally recognized “rated criteria” concept-procurement proposals will be evaluated based on various criteria.

Furthermore, provisions have been made for alternative procurement mechanisms to address state emergencies-including the application of the limited tendering method and the clarification of rules regarding professional misconduct-with the aim of ensuring the equitable distribution of resources.

To implement these timely changes, the draft of the ‘Public Procurement (Amendment) Ordinance, 2026’ was presented to the Cabinet.

The notification further stated that the draft ordinance received final approval at the Cabinet meeting, subject to vetting by the Legislative and Parliamentary Affairs Division.
