Father wins custody, mother’s sacred bond preserved

Where courtroom docks and legal statutes are often confined to cold logic, the Family Court of Dupchanchia in Bogura bore witness to a deeply touching human moment.

Caught in the painful tug-of-war of a broken marriage, the innocent affection of a child stood divided between two worlds. As six-year-old Mehjabin buried her face in her father’s chest, her eyes filled with gentle innocence. She voiced a tender plea: “Mother is very good; I want to go to my mother.” A poignant silence fell over the entire courtroom.

According to court documents, in Family Suit No. 42/2023, the father, Mohammad Mehedul Pramanik, initiated legal proceedings to secure the custody and guardianship of his minor daughter, Musammat Mehjabin.

Driven by an unwavering commitment to ensure a secure future, quality education, and proper upbringing for his child, the father gave up his livelihood abroad and returned home permanently. Following an exhaustive legal review, the court of Civil Judge Md. Tanjir Hossain granted on Thursday (August 20) custody of minor Mehjabin to her father.

Yet, this ruling is far from a routine judicial order; it stands as an exemplary document on parental duty and compassion. In his verdict, the judge observed: “Granting legal custody to the father is merely a formal judicial arrangement; it in no way diminishes the eternal honour and dignity of the birth mother.”

The judgment emphatically underscored that the maternal bond is sacred and unbreakable. A child’s personality cannot develop holistically without the tender warmth of a mother’s love.

Therefore, while the father bears full responsibility for Mehjabin’s upbringing, the mother, Mosammat Sumaiya Sultana, retains the full right to meet her beloved daughter regularly, present gifts and food with her own hands, and nurture the child’s childhood with maternal warmth.

The court issued strict directives to both parties to ensure the child is never subjected to harsh words, hostility, or psychological distress.

While marital separation breaks the bond between two adults, it often leaves a deep scar on a child’s psyche. In the eyes of a child, a father is shelter, and a mother is the entire world.

Regardless of who holds legal custody, the court’s sagacious verdict serves as a vital reminder: a child’s mental well-being must always take precedence over parental ego.
