HC rejects bail plea of ex-SP Babul in Mitu murder case

The High Court on Tuesday rejected a bail petition filed by former Superintendent of Police (SP) Babul Akhter in the murder case of his wife Mahmuda Khanam Mitu.

The High Court bench of Justice S M Kuddus Zaman and Justice Shahed Nuruddin passed the order after hearing a rule issued relating to the matter.

Lawyers Md Munsurul Hoque Chowdhury and Mohammad Shishir Manir appeared in the court hearing on behalf of Babul, while Additional Attorney General Mohammad Mehedi Hasan Chowdhury and Deputy Attorney General Sujit Chatterjee Bappi represented the state.

Later Advocate Shishir Manir said, “Babul Akhter has been serving jail since June in 2021.

In the meantime, the testimony of the 19th out of the 97 witnesses in the case has been completed.

After hearing the rule, the court intended to pass an order to conclude the trial of the case within six months.

We requested the court to consider his bail if the trial is not completed within six months.

However, the state lawyer made objection to our request.

Then the court wanted to dismiss the rule. In this circumstance, we prayed to the court to reject the petition, as it (petition) was not pressed. Then the court passed its order.”

Earlier on March 13, this year a Chattogram court framed charges against seven people including Babul Akhter in Mitu murder case.

Babul Akhtar filed a bail petition with the HC on March 6 in 2022 after failing to get bail from the trail court in the case.

Following the petition the HC on March 14 the same year issued a rule asking the respondents to explain as to why Babul Akthar should not be granted bail in the case. After the hearing on the rule, the High Court rejected the bail petition.

On June 5, 2016, Mitu was stabbed and shot dead when she was taking her son to his school bus stop at the port city’s GEC intersection.

On June 6, 2016, Babul filed a case with Panchlaish Police Station. However, finally he became an accused of the case.

On September 13 in 2022, the Police Bureau of Investigation (PBI) pressed the charges against Babul Akter and six others in the case filed over the killing of his wife Mahmuda Khanam Mitu.

The case was transferred to the Police Bureau Investigation (PBI) in 2019 after Mitu’s father, also a retired police officer, filed a complaint against the CMP’s mishandling of the case.

On May 12 in 2021, the PBI submitted its final report. Babul Akhter also filed a no-confidence petition against the PBI report on October 14, 2021.

Meanwhile, Babul Akhtar was arrested on May 12 in 2021 in another case filed by Mitu’s father and since then he has been in prison.

The PBI submitted the final report in the case filed by Babul’s father-in-law on January 25, last year.

Accepting that report, court released Babul Akhtar from the charges.
