HC dismisses challenge to 6 city corporation administrators

High Court on Thursday summarily dismissed a writ petition challenging the appointment of administrators to six city corporations, including Dhaka North and Dhaka South.

A bench of Justice Shikdar Mahmudur Razi and Justice Fatema Anwar passed the order on October 29. Deputy Attorney General Nur Mohammad Azmi represented the state.

On March 4, six people, including Supreme Court lawyer Golam Kibria, filed the writ challenging the appointments made on February 22.

The respondents included the Local Government Secretary, the Chief Election Commissioner and the chief executive officers of the six city corporations.

After the BNP-led government took office, it appointed administrators to the six corporations on February 22, replacing administrators appointed by the interim government after it assumed office in 2024 and dismissed the corporations’ mayors.

The petitioners sought a rule asking why a Local Government Division memorandum dated February 22, which appointed the administrators, should not be declared illegal and beyond the division’s legal authority. They also sought a stay on the implementation of the memorandum.

The writ further sought directions for mayoral elections in all city corporations within 30 days in accordance with the law.

The petitioners also requested that deputy commissioners oversee the corporations’ regular activities until the elections were held.

The six administrators are Abdus Salam for Dhaka South City Corporation, Shafiqul Islam Khan for Dhaka North City Corporation, Nazrul Islam Manju for Khulna City Corporation, Abdul Qayyum Chowdhury for Sylhet City Corporation, Sakhawat Hossain Khan for Narayanganj City Corporation and Shawkat Hossain Sarkar for Gazipur City Corporation.

According to the government notification, the appointments were made under sub-section (1) of Section 25Ka of the Local Government (City Corporation) (Amendment) Ordinance, 2024.

The administrators will serve as full-time heads of their respective corporations until the bodies are constituted or further orders are issued.

The notification states that they will exercise the powers and perform the duties of city corporation mayors and receive benefits and allowances in accordance with the rules. The appointments took immediate effect in the public interest.
