HC suspends Special Security Directive for 2025

The High Court (HC) has suspended the “Special Security Directive for 2025” for three months and issued a rule asking why it should not be declared illegal and unconstitutional.

The HC bench comprising Justice Fatema Nazib and Justice Shikdar Mahmudur Razi issued the order suo motu (on its own initiative) on Thursday.

The matter of the directive was brought to the court’s attention by lawyer Shishir Monir.

The court has summoned Nasimul Gani, Senior Secretary of the Ministry of Home Affairs, to explain the matter.

He has been ordered to appear in person at the High Court on March 18 to provide an explanation.

The directive, issued on March 2, has been criticised by the High Court for violating the hierarchy of the country’s top judicial authorities, including the Chief Justice and the judges of the Appellate and High Court Divisions.

Lawyer Shishir Monir raised this issue in the court, calling the directive extremely disrespectful.

The directive was said to be in conflict with the “Warrant of Precedence” (the official order of precedence) related to the seniority of the state’s important figures.

On Thursday, the court heard arguments from senior Supreme Court lawyers, Manzil Morshed and Shamsuddin Babu, before issuing its order.

The HC bench also issued the rule asking why the directive issued on March 2 regarding security provisions should not be declared illegal and unconstitutional.
