Khaleda's treatment abroad: Govt attorney asks for new application

Although the Law Ministry has already denied permission for BNP Chairperson Khaleda Zia to go abroad for her treatment, a government attorney on Monday again dictated on how she can apply in a new way for the same purpose.

While talking to the reporters at his office, Additional Attorney General Mohammad Mehedi Hasan Chowdhury said Khaleda Zia has to file petition with the Appellate Division of the Supreme Court if she wants to go abroad for her treatment. She even can appeal to the President if she wants, added the Additional Attorney General.

Mehedi Hasan Chowdhury said, “As Khaleda Zia’s sentence was suspended earlier considering a petition under Section 401 of the Code of Criminal Procedure, so there is no scope to pass any new order reviewing that application.

Now she has to go to jail and then she can place petitions with the Appellate Division of the SC for bail and permission to go abroad for her treatment as her appeal is pending against her sentence.

Apart from this, she also can make appeal to the President by admitting her guilt.”

Earlier on September 23, Law Minister Anisul Huq said an application must be submitted to the Home Ministry to allow BNP Chairperson Khaleda Zia to go abroad for better treatment.

The minister said this while talking to the reporters in Brahmanbaria’s Akhaura upazila.

“The application must be submitted to the Home Ministry, which can ask the Law Ministry for its opinion.

A decision will be reached upon their formal submission,” he said.

Khaleda Zia’s brother placed an application on September 25 in view of the public statement given by the Law Minister.

However, the Law Ministry on Sunday gave its opinion denying permission for BNP Chairperson Khaleda Zia to go abroad for her treatment.

The Law Minister on Sunday said that there is no legal scope for the government to grant permission for Khaleda Zia to go abroad for her treatment, and such opinion has been given by the Law Ministry.

BNP’s Legal Affairs Secretary Barrister Kayser Kamal, who is also a counsel for Khaleda Zia, in a reaction, said it has been proven again by the government decision regarding Begum Khaleda Zia that there is no ‘rule of law’ in the country.

He further said, “Through this decision, the most popular leader of Bangladesh, Khaleda Zia, has been subjected to a terrible joke.

Section 401 of the Code of Criminal Procedure clearly states that the government can release her by executive order.

Today, an ‘unelected’ Prime Minister took this decision out of political revenge, although there are instances in the national and international law to release the prisoners and get them treated abroad.

The government’s decision is the worst fraudulence with the nation.”
