Khaleda Zia’s treatment: No need of court order for going abroad, says Shahdeen Malik

The physical condition of BNP Chairperson Begum Khaleda Zia is deteriorating day by day as the senior lawyer said that there is no need to take court’s permission for taking better treatment abroad as she already freed through executive order.
Meanwhile, leaders of Bangladesh Nationalist Party (BNP) said that 100% treatment of Khaleda Zia is not possible in the country as her physical condition has started to deteriorate.
Though BNP has been demanding of the government to send Khaleda Zia to receive better treatment immediately considering her health condition, but the government has cleared that there is no scope to send BNP Chairperson abroad as per law.
Senior lawyer Dr. Shahdeen Malik said that there is no need for separate permission from the court regarding the treatment of Khaleda Zia abroad.
“As Khaleda Zia was released through an executive order. So, all other steps can be done within the scope of this order.
The government can release any prisoner with or without conditions according to Section 401 of the Code of Criminal Procedure,” he told the BBC Bangla.
Khaleda Zia was first released with two conditions, the lawyer said.
“The conditions are she must stay at home and receive treatment inside the country,” he added.
According to Shahdeen Malik, what the Law Minister says that the condition cannot be changed, but it has actually been changed five times already.
“At first it gave a six-month release and then extended for six months again under a new executive order.
It means that if the government wants to simply drop the word “Dhaka” instead of treatment in Dhaka,” the noted lawyer said.
It is not a matter of court, the legal expert said, adding that the court has already given its verdict against Khaleda Zia.
“Khaleda Zia’s bail has been sought several times but it rejected by the court.
It means that the court’s chapter already ends.
It might be move to the court, but it is not the court’s business.
Because the court has not released her as she was released by executive order,” Shahdeen Malik said.
However, BNP Secretary General Mirza Fakhrul Islam Alamgir said that Begum Khaleda Zia is very sick as her physical condition is getting worse day by day.
Meanwhile, Begum Khaleda Zia, who is now undergoing treatment at Evercare Hospital in Dhaka, was shifted twice to the Coronary Care Unit (CCU) after deteriorating her physical condition.
Doctors have already been suggested the BNP leaders to send BNP Chairperson for better treatment from an advanced hospital immediately.
The 78-year-old former prime minister has been suffering from various ailments, including liver cirrhosis, arthritis, diabetes, kidney, lung, heart, and eye problems.
Since her conditional release in 2020, the BNP chief has been receiving treatment at the hospital under a medical board headed by cardiologist Prof Shahabuddin Talukder.
On August 9, Khaleda Zia was admitted to Evercare Hospital after falling seriously ill at her Gulshan residence Feroza by the decision of her medical board.
Khaleda was sent to the Old Dhaka Jail after a lower court sentenced her to five years’ imprisonment in the Zia Orphanage Trust corruption case on February 8, 2018. Later, she was found guilty in another corruption case the same year.
Amid the coronavirus outbreak, the government temporarily freed Khaleda Zia from jail through an executive order suspending her sentence on March 25, 2020, with the condition that she stay in her Gulshan house and not leave the country.
