HC clears way for G M Quader to perform as Jatiya Party chief

The High Court on Sunday stayed for eight weeks a Dhaka Court Order that on January 19 this year prohibited Ghulam Muhammed Quader (G M Quader) to perform activities as the Chairman of the Jatiya Party.
The High Court Bench of Justice Muhammad Abdul Hafiz passed the order after hearing a revision petition filed by G M Quader against the Dhaka Court rejection order.
Lawyer Sheikh Muhammed Serajul Islam who appeared for G M Quader in the HC hearing said that there is no legal bar for his client to discharge duties as Jatiya Party Chairman following the HC order.
The HC Bench also issued a rule asking the authorities concerned to explain as to why the lower court order barring G M Quader to perform activities as the Chairman of the Jatiya Party should not be declared.
Earlier on October 31, last year, a Dhaka Court issued an injunction barring G M Quader from taking any political decision regarding the party.
The injunction came following an application filed by former JP lawmaker Advocate Ziaul Haque Mridha, also a former Adviser to the JP chief, was removed from the party on September 17, last year.
On November 16, the same Dhaka Court in an order said the injunction barring G M Quader from making any political decision of the party would remain in force and therefore, he could not make any political decision concerning the party.
G M Quader then filed an appeal petition with the District and Sessions Judge’s Court in Dhaka against the trial court order.
Meanwhile, the Appellate Division of the Supreme Court on December 14 ruled that GM Quader cannot perform responsibilities as the Chairman of the Jatiya Party. The apex court, however, ordered the lower court concerned to hear and dispose of the case filed in connection with the issue by January 9.
Complying with the apex court order, the District and Sessions Judge’s Court on January 19 in 2023 passed its order upholding trial court ruling prohibiting GM Quader to perform activities as the Chairman of the Jatiya Party.
GM Quader then moved HC and filed a revision petition.
