GM Quader can’t perform duties as JaPa chairman: SC
Staff Reporter :
The Appellate Division of the Supreme Court on Wednesday ruled that GM Quader could not perform responsibilities as the Chairman of the Jatiya Party.
The Appellate Division of the SC, however, ordered the lower court concerned to hear and dispose of the case filed in
connection with the issue by January 9. A three-member bench of the Appellate Division headed by Chief Justice Hasan Foez Siddique passed the order after hearing a petition challenging the High Court order that cleared the way for Quader to perform the responsibilities of his post.
Former JP leader Ziaul Haque Mridha filed the petition seeking stay on the HC order. Following the petition, the SC chamber judge on November 30 stayed the HC order that cleared the way for GM Quader to perform the responsibilities of his post.
Justice M Enayetur Rahim, the apex court chamber judge, also sent the plea to its full bench for further hearing on the matter.
On November 29, the HC bench of Justice Sheikh Abdul Awal stayed till January 3 a Dhaka court directive that on November 16 upheld an injunction order asking GM Quader to refrain from party activities.
On November 16, a Dhaka court in an order said the injunction barring GM Quader from making any political decision of the party would remain in force and therefore, he could not make any political decision.
Earlier on October 31, the court issued an injunction barring GM Quader from taking any political decision regarding the party.
The injunction came following an application filed by former JP lawmaker advocate Ziaul Haque Mridha. Mridha, also a former adviser to the JP chief, was removed from the party on September 17, this year.
Lawyer Sayeed Ahmed Raza appeared for Ziaul Haque Mridha, while lawyer Sheikh Muhammed Serajul Islam stood for GM Quader during the hearing on Wednesday.
