HC bans broadcasting of fugitives’ statements

The High Court on Wednesday issued an injunction upon publishing and broadcasting of statements, interviews and talk shows of any convicted and fugitive accused, including much talked Proshanta Kumar Halder, popularly known as PK Halder.
All types of print media, electronic media and social media have been asked to
abide by the directive till further order of the court or till disposing of the ruling issued by the court regarding PK Halder.
Ekattor TV, a private TV channel of the country, aired a live talk show program on December 28 this year under the banner of ‘Ekattor Journal’, where they connected PK Halder, an absconding accused in some money laundering cases.
The channel also aired an interview of PK Halder in their news program on the same day.
Later the lawyer of the Anti-Corruption Commission, Khurshid Alam Khan, brought the matter to the attention of the High Court in written on Wednesday.
After holding hearing on the matter, the High Court bench of Justice Md Nazrul Islam Talukder and Justice Ahmed Sohel passed the injunction order.
Besides, the court ordered the Ekattor TV authorities to submit the video clips of PK Halder aired by the television channel in their news and talk show programs before the registrar office of the High Court division of the Supreme Court by January 10 next year.
Advocate Khurshid Alam Khan took part in the hearing on behalf of the ACC, while Deputy Attorney General AKM Amin Uddin Manik represented the state.
The petition said, “Earlier another High Court bench directed to take all necessary measures to prohibit all medias from publishing and broadcasting any statement passed by the Tarique Rahman until he remains a fugitive in the eye of lawyer.”
Quoting the earlier High Court decision the ACC lawyer said, “PK Halder is a fugitive. In the talk show he was defending himself. A Suo Moto (voluntary move) ruling is pending against him and an arrest warrant was also issued by a Dhaka Court against him. In this circumstance how a TV channel telecast his speech in a live program?”
Halder while officiating as the managing director of Reliance Finance Ltd, a non-bank financial institution, had made his relatives directors of three other leasing companies to swindle money.
