Sarwar Alamgir can take oath as Ctg MP: HC

The High Court (HC) has ruled that Sarwar Alamgir, the BNP candidate who won the Chittagong-2 constituency in the 13th National Parliament election, can take oath as a member of parliament.
The court declared his candidacy valid and gave this ruling.

A High Court bench comprising of Justice Fahmida Quader and Justice Md. Asif Hasan announced this ruling on Thursday.

Earlier, after hearing on the rule on July 2, the court fixed July 9 for the verdict.
Senior lawyer Ahsanul Karim and Barrister AM Mahbub Uddin Khokon were present in the court for the writ petitioner.

On the other hand, senior lawyer Shishir Monir and lawyer Azim Uddin Patwary were present for Jamaat candidate Md. Nurul Amin.

After Sarwar Alamgir’s candidacy was declared valid by the returning officer, Jamaat candidate Md. Nurul Amin appealed against him, alleging loan default. After the hearing, the Election Commission canceled Sarwar Alamgir’s candidacy on January 18.

Sarwar Alamgir filed a writ petition in the High Court against this.

On January 27, the High Court suspended the Election Commission’s order. At the same time, a rule was issued allowing him to participate in the election.

Later, Nurul Amin filed a leave to appeal against the High Court order in the Appellate Division. The Appellate Division granted leave to appeal on February 3.

As a result, although Sarwar Alamgir was given the opportunity to participate in the election, his election results were ordered to be suspended until the appeal was resolved. That is, even if he was able to participate in the election, his results could not be published.

Later, Sarwar Alamgir won the February 12 election. However, his results were not published due to the court’s instructions.

Then, after hearing the appeal filed by Jamaat candidate Nurul Amin, the Appellate Division issued an order on June 16. The order directed the High Court to resolve the rule quickly, if possible within two weeks, after resolving the appeal.
