SC hearing on banning Jamaat deferred till Nov 19

The Appellate Division of the Supreme Court on Sunday set November 19 this year to hold hearing on an appeal petition filed against a High Court verdict that declared illegal Jamaat’s registration with the Election Commission (EC).

A five-member bench of the Appellate Division headed by Chief Justice Justice Obaidul Hassan passed the order after hearing on the case.

The apex court will also hold hearing on two other petitions on that day.

One petition sought a ban on the political activities of Bangladesh Jamaat-e-Islami, and another filed for issuing contempt of court charges against Jamaat Amir (party chief), Secretary General and other central leaders of the organization.

Rezaul Haque Chandpuri, Secretary General of Bangladesh Tariqat Federation, and two others filed the two petitions with the Appellate Division on June 26.

Earlier on November 6, the apex court fixed November 12 for hearing on the two petitions filed by Rezaul Haque Chandpuri and two others. Accordingly the petitions came for hearing on Sunday.

However, A J Mohammad Ali, a counsel for Jamaat, could not appear in the court for personal difficulties, and lawyer Md Ziaur Rahman on behalf of Mohammad Ali sought time from the court.

On the other side, Barrister Tania Amir and Advocate Ahsanul Karim appeared in the hearing on behalf of Rezaul Haque Chandpuri and two others.

Hearing the parties, the apex court fixed November 19 for further hearing on the issues.

Later Mr Ahsanul Karim said, “The High Court declared the EC registration given to Jamaat illegal.

At the same time, the HC gave direct certificate to the party to file appeal petition against its verdict.

Therefore, they don’t need to file any leave to appeal petition (permission to file appeal petition) against the verdict.
