SC clears way for labour court to continue trial against Grameenphone

The Appellate Division of the Supreme Court has cleared the way for the labour court concerned to continue the proceedings of the 22 cases filed against Grameenphone Limited, one of the top telecommunication service providers of the country, by its former 22 employees who were retrenched form their job.

The apex court has upheld a High Court order that in 2019 discharged a writ petition filed challenging the legality of the cases running in the labour court.

A three-member bench of the Appellate Division headed by Chief Justice Hasan Foez Siddique passed the order on August 6, after dismissing several petitions filed by the Grameenphone against the HC order.

the GP, said, “Grameenphone in 2012 illegally terminated the employees due to formation and organizing ‘Grameenphone Employees Union (GPEU)’.

Then 22 employees filed 22 cases with the Labour Court-1 in Dhaka.

On the other hand, the authorities of the GP filed a petition with the labour court seeking discharge of the cases filed against it by its former employees. However, the labour court rejected the petition filed by the GP.”

The Grameenphone authorities in 2015 filed a writ petition with the High Court challenging the legality of the cases running in the labour court. After hearing the High Court in 2019 rejected the rule issued following the writ petition.

The GP authorities then moved the apex court. After hearing the petitions filed by the GP the apex court rejected those on August 6.

Lawyer Tapas Kanti Baul said now there is no bar to continue the trial proceedings of the cases filed with the labour court by the retrenched employees.
