SC to hear contempt of court petition against Taposh on Aug 14

Staff Reporter  :
A full bench of the Appellate Division of the Supreme Court will hold hearing on August 14 on a contempt of court petition filed against Dhaka South City Corporation (DSCC) Mayor Sheikh Fazle Noor Taposh.

Chamber Judge of the Appellate Division Justice M Enayetur Rahim on Monday set the date after a brief hearing on the petition.
On Sunday, a contempt of court petition was filed with the Appellate Division against Taposh for his comments about a former Chief Justice and civil society.

Shah Ahmed Badal, Member-Secretary of the Ad-hoc Committee of the Supreme Court Bar Association (SCBA), submitted the petition to the office concerned of the SC, saying that the utterances made by Taposh have constituted contempt of the highest court of the country and the judiciary as a whole.

In the petition, he appealed to the apex court to issue a notice to Taposh asking him to explain as to why he should not be punished for his “flagrant disregard and willful contempt of the office of the Chief Justice and highest judiciary”.

The lawyer, in the petition, also urged the SC to bring Taposh before it in person and impose a fine on him for his comments.

On May 21 this year at a program of Bangabandhu Awami Ainjibi Parishad held at the Supreme Court Bar Association auditorium Taposh said, “Ekjon Chief Justice keo Namiye Diyechhilam (we had even brought down a Chief Justice)”.

Earlier on May 24, eminent jurist M Amir-Ul-Islam placed the comment made by Mayor Taposh before the Appellate Division.

Before the court, Amir-Ul-Islam, one of the framers of the Constitution, read out a portion of a report published by the daily Manab Zamin on May 23 in which Taposh was quoted as saying, “We had even brought down a Chief Justice.”

However, Chief Justice Hasan Foez Siddique did not give any decision immediately after the comment was placed and said, “We will see the matter later on.”

Since we didn’t found any decision from the Appellate Division, we filed a contempt of court case against Taposh, said Shah Ahmed Badal.
