‘Special child’ in HC to get deceased father’s salary

Sardar Abdur Razzak, a former Senior Officer of the Rupali Bank Limited, died 11 years after a court declared him innocent in a criminal case. He tried to join his service while alive, but failed.

Then his ‘special child’ Sardar Asaduzzaman applied last year to the Chairman of bank to get his deceased father’s outstanding salaries and service benefits. Finally Asaduzzaman and his two sisters filed a writ petition with the High Court as they didn’t get any remedy.

The writ petition filed by these three siblings came up for hearing in the High Court on Monday.

Upon hearing the petition the High Court asked the Rupali Bank Chairman and other respondents to dispose of the representations submitted by Asaduzzaman and her sisters to get his father’s outstanding salaries and other service benefits.

The High Court bench of Justice Mahmudul Hoque and Justice Md Mahmud Hassan Talukder passed the order after hearing the writ petition.

Sardar Asaduzzaman said, “My father joined the bank around 1973-74. He tried to join the service again in 2010 after being declared innocent by the court. But he failed. He was bedridden since paralysis in 2014. He died on August 15 in 2021. Now we want to get my father’s outstanding salaries and benefits.”

This disabled person, a graduate student of the Khulna City College, said that his life is going on with the aid sent by his sisters.

According to the case documents, Sardar Abdur Razzak was working as the Manager of Baradal branch of the bank in Satkhira. While Abdur Razzak is in service, a case was filed against him and two others with the Ashashuni Police Station on July 13 in 2002 on charge of irregularities of Tk 9 lakh. In the case, a charge of embezzeling Tk 1 lakh and 58 thousand was brought against Abdur Razzak.

A month before that, on June 2, he was suspended.

He was later dismissed from the job on September 25, 2006.

Khulna Divisional Special Judge Court delivered the judgment on September 27, 2010 in the case of financial irregularities. The court acquitted Abdur Razzak in the verdict. Two others were sentenced to various terms and fined.

Being acquitted from the charge, Abdur Razzak appealed to the Chairman of the Rupali Bank to join the job again.

However, he didn’t get the chance. Finally He passed away on August 15 in 2021.

In this circumstance, Sardar Asaduzzaman, son of Abdur Razzak, submitted an application on November 6 in 2022 with the Chairman of the Rupali Bank to get outstanding salaries and other servicer benefits of his father. But he didn’t get any response from the bank authorities.

In this situation, Asaduzzaman and his two sisters filed the writ in March this year challenging the inaction of the bank authorities to take necessary steps as per the application made to the Chairman of the bank.

Lawyer Kazal Rashid Biswas appeared in the court hearing on behalf of Asaduzzaman, while Deputy Attorney General KM Masud Rumi represented the state.
