HC to Govt

Appoint 27 BCS candidates within 60 days

Staff Reporter :
The High Court on Tuesday directed the government to appoint 27 candidates, who passed the 34th and 35th Bangladesh Civil Service (BCS) exams, but were not given appointments.
The authorities have also been asked to appoint them from the date of recommendation by the Public Service Commission (PSC). One of them passed the 34th BCS and the rest 26 passed 35th BCS exams. The government has been asked to appoint the candidates at their respective posts within 60 days of receiving the High Court judgement.
The court also declared the government decision to drop them from the recruitment process as “illegal”.
The HC bench of Justice Md Ashraful Kamal and Justice Razik-Al-Jalil delivered the verdict after hearing three separate writ petitions filed by the deprived candidates, challenging the legality of the government decision.
Advocate Md Salahuddin Dolon, advocate Mohammad Siddique Ullah Miah and advocate Abdus Sattar Palowan appeared in the court on behalf of the candidates while deputy attorney general Wayesh Al Haruni stood for the state.
Advocate Siddique Ullah Miah who appeared in the court for 17 candidates, said that his clients passed the BCS examination and Bangladesh Public Service Commission (PSC) had recommended the government for their appointment. But the authorities concerned did not give them appointment nor an explanation as to why they were not recruited, he said.
The government will have to give the appointments and provide the candidates with the salaries and benefits from the date of PSC’s recommendation, the lawyer added.
Public Service Commission published the result of 35th BCS on August 17, 2016 and recommended to appoint 2158 candidates. Later 2118 candidates got appointment. 26 candidates of the rest 40 filed writ petition with the High Court seeking appointments.
Besides, one candidate of the 34th BCS filed writ petition on the same ground.
