Government should worry about its unpopularity and not the Supreme Court judgement.
Howling and shouting or foul language is not the way to treat, even to criticise judgement of the highest court involving the Constitution and constitutional government.
The Supreme Court does not and cannot usurp the government. But its anxieties about the misuse of power and failures of the government are to be taken seriously for the reason that it has no political axe to grind. Some of those who are desperate to remain in power but incompetent for good governance are found to be more bitter and foul mouthed against the judgement. Nowhere not even in Pakistan the army took power for any adverse judgement of the Supreme Court.
The unconstitutional martial law government was imposed to depose a failed government. The people welcomed the change. Recently two Prime Ministers were found disqualified in Pakistan by the Supreme Court and they had to go. But no judge benefitted.
The Supreme Court as protector of the Constitution has an obligation to see that the government is run as required by the Constitution for serving the people.
It is allowed to discuss and disagree with the judgement. But no government is safe by threatening the power of the judges while being careless about its growing unpopularity .It makes no sense to compare the situation in Pakistan about the effect of the recent judgements of the Supreme Court of Pakistan.
The fundamental truth is that a political government survives on the strength of popularity. It is vulnerable to other forces when popular force is not with the government. If the government wants to pretend it will do so at its own cost. It is best to admit its unpopularity.
Bangabandhu as Father of the Nation is to be seen as everybody’s father. To make Bangabandhu an affair of party politics for the benefit of bad party politics is not honouring him as Father of the Nation. He is father to all of us and he will be for all.
In our assessment the situation is that the more the government goes against the Supreme Court the more unpopular government becomes.
After the judgement the most helpful thing to do for the government would have been to reorganise the government to make it honest and competent.Â
The 16th Amendment was meant for denial of checks and balances provided by the judiciary and the Constitution. To be more blunt the 16th Amendment has challenged the very sovereignty of the people and their right to be governed by their Constitution.
The Supreme Court has offered a lifeline to the government to save itself as the democratic government, protected by the Constitution.
