Rent collection obstruction complaint found in Jatrapur market
Khulna Bureau :
A complaint has been received about obstruction of rent collection in the traditional Jatrapur market of Bagerhat.
Beg Mahfuzur Rahman Badal, a partial claimant of the market, has filed a complaint in this regard with the Upazila Executive Officer and the Deputy Commissioner.
In the complaint, he has also requested the administration to take action so that the administration does not collect rent from his land and does not obstruct him from collecting rent. The complainant, Beg Mahfuzur Rahman Badal, is the son of the deceased Yusuf Ali Beg of Rahimabad area. He has sought the intervention of the administration in this regard so that he can collect rent from the market peacefully.
The complainant said that Beg Yusuf Ali obtained a degree from the court for .82 acres of land in Jatrapur market.
When the government filed an appeal, the case was dismissed on July 24, 2011. When the government tried to construct a building and lease the land again, the complainant filed a writ petition in the High Court. On March 18, the court ordered to maintain the status quo.
The complainant further stated that the district administration is trying to collect rent from Jatrapur Hat by disobeying the court order and not allocating the .82 acre land received. Moreover, the complainants are being prevented from collecting rent from the market. Despite discussions with the local administration on the matter several times, no solution is being found.
In this regard, Bagerhat District Government Law Officer (GP) Advocate Molla Muzaffar Ali mentioned in his opinion that the state has grossly neglected the case between the state and Beg Yusuf Ali. There is no opportunity to appeal again.
The permanent injunction judgment has already been disobeyed. If Beg Yusuf Ali files a lawsuit or demands compensation for violation of courts order amounts to contempt of court, he will get a remedy in the situation.
Moreover, the High Court is very vigilant in providing remedies in that lawsuit in the interest of protecting the existence and honor of the lower courts.
In an opinion given to the Assistant Commissioner of Land, Bagerhat Sadar, in order to avoid the liability of all those lawsuits without taking any risks or being damaged, the degree holder side expressed its opinion in favor of taking immediate steps to resolve the dispute by promising that it would not demand compensation or file a violation lawsuit.
