SC upholds HC order to accept Fakhrul’s bail petitions

The Appellate Division of the Supreme Court on Monday upheld a High Court order that on December 18 directed the Chief Metropolitan Magistrate’s Court in Dhaka to accept, hear and dispose the bail petitions of BNP Secretary General Mirza Fakhrul Islam Alamgir in connection with nine cases.

A four-member bench of the Appellate Division of the SC headed by Chief Justice Obaidul Hassan dismissed the petition filed by the state challenging the HC order.

The bench passed the order as the HC order passed on December 18 last year has already been implemented and therefore, the state’s petition has become infructuous, said Fakhrul’s lawyer Sagir Hossain Leon.

Judge of the Additional Chief Metropolitan Magistrate Court in Dhaka, Sultan Sohag Uddin, on January 10 accepted the bail petitions of Mirza Fakhrul Islam Alamgir and granted him bail in nine cases filed with Paltan and Ramna police stations.

On December 18, the High Court directed the Chief Metropolitan Magistrate’s Court in Dhaka to accept, hear and dispose of the bail petitions of Fakhrul in connection with the nine cases.

Later on December 21, the Chamber Judge of the Appellate Division of the Supreme Court upheld the High Court order regarding the nine cases and sent the matter to the regular Appellate Division bench to be heard on January 15.

The cases were filed on charges of killing a police constable, illegal gathering on the street, vandalising vehicles, rioting, snatching a police weapon, damaging properties, assaulting policemen and preventing them from discharging their duties.

On October 29, Mirza Fakhrul was arrested in connection with the case filed with Ramna Police Station over the attack on the residence of the Chief Justice during a clash with police on October 28.
