The High Court on Monday ordered the Dhaka North City Corporation authorities to realize its outstanding dues from the five-star hotel, which was established by constructing a multi-storied building on the place of City Corporation in Banani area of the capital, according to the contract in two months.
The court also asked the DNCC authorities to submit a report in this regard within next three months.
The High Court bench of Justice Md Nazrul Islam Talukder and Justice Khizir Hayat passed the order and issued a rule after hearing a writ petition filed in this regard.
It also issued a rule asking the respondents to explain as to why their failure to realize the outstanding dues from the Borak Real Estate should not be declared illegal.
Barrister Syed Sayedul Haque Suman, a Supreme Court lawyer, filed the writ petition on June 11 seeking HC directives upon the respondents to conduct an inquiry into the contact between Borak Real Estate Ltd (BREL), owner of the five-star hotel, and the DNCC.
Barrister Suman himself argued for his petition, while lawyers Md Ramzan Ali Sikder and Abu Taleb appeared for the Borak Real Estate Ltd.
On June 1 this year, a newspaper report was published under the banner of ‘Sorkari jomite panch taroka hotel (Five star hotel in govt land)’. Barrister Suman then filed an application with the Anti-Corruption Commission (ACC) seeking an inquiry into matter. However, the ACC unheeded his application. Then he moved the High Court.
According to the published report, “Borak Real Estate Ltd has occupied a 60-khata land of the City Corporation in Banani, an elite area of the capital, by establishing a 28-storey building. A five-star hotel has been launched there.”
“Dhaka North City Corporation (DNCC) says that the contract with Borak Real Estate was to build a 14-storey building, 30 percent of which was supposed to be given to the City Corporation and the rest to the Borak. According to the City Corporation, their share of the assets is valued at around Tk 5.5 billion.
However, the city corporation could not realize it’s part of the assets even in the last one decade. On the contrary, by violating the terms of the contract, Borak has built a 28-storey building instead of 14-storey and has kept the whole under their control,” also read the published report.
