HC questions new recruiting policy of NTRCA

The High Court (HC) on Tuesday issued a rule upon the government to show cause as to why the fixing of 35 years as the teachers recruitment age under the Manpower Structure Policy 2018 of Non-Government Teachers’ Registration and Certification Authority (NTRCA) should not be declared illegal.
The HC also wanted to know in a the rule as to why the candidates who are above 35 years but received the registration certificates of the NTRCA before issuing the policy should not be declared as the valid candidates.
At the same time, the HC ordered the government to preserve posts for 105 candidates who had received registration certificates to be appointed in private educational institutions before issuing the policy.
The High Court bench of Justice F R M Nazmul Ahasan and Justice K M Kamrul Kader passed the order after hearing a writ petition filed by some teacher candidates.
105 teacher candidates including A T M Shariful Islam of Gaibandha, Md Ayub Ali of Magura, Shankar Kumar Majumder of Pirojpur, Habibur Rahman of Jhinaidah and Rashedul Hasan of Sirajganj filed the writ petition.
They challenged the Sections 6 and 11 of the Manpower Structure Policy 2018 of NTRCA in the writ petition.
The Education Secretary and NTRCA Chairman were asked to comply with the rule within four weeks.
Advocate Mohammad Siddiq Ullah Miah appeared for the writ petitioners, while Deputy Attorney General A B M Abdullah Al Bashar stood for the State.
On December 18, 2018, the NTRCA authorities published a circular seeking application from the candidates for the posts of private schools, colleges, madrasas and technical educational institutions. The authorities said in the circular that only those can be allowed to apply in the posts whose age is 35 or under 35 in the date of June 12, 2018, and who will fulfill the other conditions of the Manpower Structure Policy 2018 of NTRCA.
The Sections 6 and 11 of the policy describe the condition of 35 years for applying in the posts. For those sections the candidates of above 35 years are not eligible to apply.
