Justice Muhammad Khurshid Alam Sarkar of the High Court Division has been dismissed from his post as a judge.
A gazette notification issued by the Law and Justice Division and signed by Secretary Liaquet Ali Molla on Tuesday stated that the decision followed an investigation by the Supreme Judicial Council (SJC), which found Justice Khurshid Alam Sarkar “incapable of properly discharging the responsibilities of his office.”
“Accordingly, under Clause 6 of the restored Article 96 of the Constitution, the President has removed him from office effective 5 November,” the notification read.
The removal marks a rare instance of a sitting High Court judge being dismissed following a formal investigation by the SJC—the constitutional body empowered to inquire into allegations of misconduct or incapacity of judges of the Supreme Court.
Justice Khurshid Alam Sarkar, who was appointed as an Additional Judge of the High Court Division in 2010 and confirmed as a permanent judge in 2012, came to public attention in recent years for several high-profile rulings.
