ICC issues arrest warrant for Israeli PM, others

The International Criminal Court (ICC) has issued arrest warrants for Israeli Prime Minister Benjamin Netanyahu, former Defense Minister Yoav Gallant, and a senior Hamas official, accusing them of war crimes during and after the October 7 attacks on Israel last year.

“The chamber issued warrants of arrest for two including Benjamin Netanyahu and Mr Yoav Gallant as it found “reasonable grounds” to believe that Netanyahu bears criminal responsibility for crimes against humanity and war crimes committed from at least 8 October 2023 until at least 20 May 2024, the day the Prosecution filed the applications for warrants of arrest,” the Hague-based ICC said in a statement.

It also rejected two Israeli challenges to its jurisdiction, saying “The acceptance by Israel of the Court’s jurisdiction is not required, as the Court can exercise its jurisdiction on the basis of territorial jurisdiction of Palestine.”

The decision turns Netanyahu and the others into internationally wanted suspects and is likely to further isolate them and complicate efforts to negotiate a cease-fire to end the 13-month conflict. But its practical implications could be limited since Israel and its major ally, the United States, are not members of the court and several of the Hamas officials have been subsequently killed in the conflict, according to AP.

The ICC is a court of last resort that only prosecutes cases when domestic law enforcement authorities cannot or will not investigate. Israel is not a member state of the court. The country has struggled to investigate itself in the past, rights groups say.

Despite the warrants, none of the suspects is likely to face judges in The Hague any time soon. The court itself has no police to enforce warrants, instead relying on cooperation from its member states.

The Israeli prime minister’s office dismissed the warrants as “absurd and antisemitic.”

“Israel utterly rejects the absurd and false actions and accusations against it by the International Criminal Court, which is a politically biased and discriminatory body,” his office said. “There has been no more war than the one Israel is fighting in Gaza since October 7, 2023, after the Hamas terrorist organization launched a murderous attack against it, carrying out the largest massacre against the Jewish people since the Holocaust.”
