HC directs DGHS to probe Lab Aid case

The High Court on Sunday directed the Director General of the Directorate General of Health Services (DGHS) to conduct an investigation into an allegation that wrong treatment of a doctor of the Lab Aid Specialized Hospital in Dhaka damaged two kidneys of a patient, Md Yousuf Mazumder alias Shakil.

The DG of the DGHS has been asked to submit a report to the court within two months after conducting the investigation.

The High Court bench of Justice K M Kamrul Kader and Justice Khizir Hayat passed the order after hearing a writ petition filed by Yousuf Mazumder.

The court also issued a rule upon the respondents including the Lab Aid Specialized Hospital authorities to explain in four weeks as to why they should not be directed to pay Tk 10 million to Yousuf Mazumder as compensation for their wrong treatment that damaged his two kidneys.

Lawyer Aklas Uddin Bhuiyan appeared in the court hearing on behalf of Yousuf Mazumder.

Later, Mr Aklas Uddin said, “Major General Prof Dr H R Harun, a consultant of Urology Department of the Lab Aid Hospital’s Dhanmondi Branch in Dhaka, gave a wrong treatment to my client, Yousuf Mazumder. Now his two kidneys are damaged, and he is in a death risk. In this situation we have filed the writ petition.”

Upon hearing the petition, the High Court directed the DG of the DGHS to conduct a probe into the allegation and issued a rule for compensation, said the lawyer.

Earlier, on January 15 this year another HC bench directed the DG of the DGHS to take steps to investigate the death of five-year-old Ayaan at the United Medical College Hospital in Dhaka and to submit a report in seven days.

The HC bench of Justice Mustafa Zaman Islam and Justice Md Atabullah issued the order and rule following a writ petition filed by Supreme Court lawyer A B M Shahjahan Akand Masum seeking necessary directives.

The HC also asked the DG of DGHS to submit a list of the hospitals with licences and without licences to it in one month. It also asked the DG of DGHS to submit a list of the patients who died earlier at the same hospital due to mishandling and negligence of its doctors within three months.

Ayaan, a nursery student at a private school in the capital, passed away following a circumcision procedure conducted at United Medical College Hospital in the capital’s Badda area. Ayaan’s father Shamim Ahmed alleged that the hospital’s mishandling led to the loss of his child.
