Digital access enshrined as a core right in landmark cyber ordinance
THE approval of Bangladesh’s Cyber Security Ordinance 2025 marks a landmark advancement in the country’s digital legal framework. The ordinance repeals nine problematic sections of the Cyber Security Act 2023, which had enabled harassment and suppression through legal misuse. The automatic dismissal of about 95% of related ongoing cases signals a decisive break from this troubling legacy. In its place, the new law focuses on genuine protection rather than repression.
A historic feature of the ordinance is the recognition of internet access as a civic right, underlining the essential role that connectivity now plays in education, commerce, and social participation. This declaration aligns Bangladesh with global standards, affirming digital access as fundamental.

Importantly, the ordinance reforms speech-related offences by making them bailable and reducing maximum imprisonment to two years, thus protecting free expression. At the same time, it introduces harsher penalties for filing false or malicious cyber cases, curtailing abuse of the legal system.
Another significant reform is the removal of offences concerning the Liberation War, national figures, and symbols. These provisions were often politically exploited, restricting dissent. Their omission marks a clear commitment to safeguarding digital freedoms and focusing law enforcement on genuine threats.
