It has been alleged that the Directorate of Inspection and Audit (DIA) has submitted an investigation report ignoring multiple court rulings on the legal appointment of the current principal of the capital’s Mirpur Bangla School and College, Md. Mostafa Kamal Khoshnabish.
It is learned that on July 30, the DIA investigation team sent an investigation report on the principal and other teachers of the institution to the Secretary of the Secondary and Higher Education Division of the Ministry of Education.
The investigating officers commented on the principal, saying that the appointment approval authority had issued illegal instructions to the education ministry against the acting principal who was a member secretary of the governing body proving the allegations that the appointment process of the governing body was not correct.
After reviewing the relevant documents, it was found that on
the recommendation of the report of the Department of Inspection and Audit, a letter was issued to the Director General of the Directorate of Secondary and Higher Education on May 13, 2018, through letter no. 37.00.0000.000.39.017.17.124, to take disciplinary action against Assistant Principal ABM Abdus Salam.
Later, acting Principal ABM Abdus Salam filed Writ Petition No. 6233/2018 against that letter. On May 16, 2018, the court stayed the operation of that letter for four weeks in view of that writ. Acting Principal Abdus Salam applied to the ministry with a copy of the judgment, and through letter no. 37.00.00000 .000.39.017.17.168 on June 25 of that year, the ministry suspended the effectiveness of letter no. 37.00.00000.000.39.017.17.124 on May 13, 2018 and letter no.
37.00.0000.000.39.017.17.155 on June 10 of the same year for an indefinite period.
While the suspension was in place, the governing body for the periods of appointment of the principal and the appointment of the vice principal were completed.
Later, when the government filed a civil petition for leave to appeal no. 2703/2018 in the Appellate Division against Writ Petition no. 6233/2018 of ABM Abdus Salam, the court continued the matter for hearing in the full bench.
Later, on July 22, 2018, a four-judge bench led by the Chief Justice unanimously dismissed the appeal filed by the government against Writ Petition No. 6233/2018 as there was no merit in it. As a result, the allegations against Acting Principal Abdus Salam were proven to be baseless and he performed the duties of the Acting Principal as a legitimate Assistant Principal.
Regarding this, Principal Mustafa Kamal Khoshnabish said, “Nowhere in the DIA investigation report did I call him illegal.”
The appointment was made in a proper manner. When Acting Principal ABM Abdus Salam was serving as the Member Secretary, the decision to issue a recruitment notice for the appointment of the Headmaster was made in the approved Governing Body of the Secondary and Higher Secondary Education Board meeting on February 14, 2019, he said.
The President issued a notice in the newspaper and I applied to the President for the vacant post of Headmaster. All concerned, including the President, were present at the recruitment board. I participated in the recruitment test and secured first place and was appointed as per the decision of the Governing Body, he further said.
The president gave me an appointment letter. In view of the appointment letter, I joined Mirpur Bangla School and College as the head teacher on March 18, 2019, having complied with all the relevant matters, Principal Mustafa Kamal added.
