AL ban legally feasible

Dr Asif Nazrul, Adviser on Law, Justice and Parliamentary Affairs, has stated that there is no legal impediment to banning the Awami League (AL), citing provisions in existing laws such as the Anti-Terrorism Act.

In a post published on his verified Facebook account on Friday, the law adviser said, “There is no disagreement among advisers about taking action against the Awami League.

Views may differ regarding the procedure, but if required, the ICT Act can be amended within days. Existing legislation, including the Anti-Terrorism Act, is sufficient to impose a ban on the party.

So, the law is not a problem.”Dr Nazrul, who is also a professor of law, said the banning of a political party could be pursued legally if there is demand from political stakeholders and if trial courts issue rulings or observations supporting such action.

He revealed that the Law Ministry has drafted a provision to empower authorities to ban an organisation under the International Crimes Tribunal Act, specifically to facilitate action against the Awami League.

“As the law adviser, I personally proposed this draft amendment in the Advisory Council meeting. Therefore, it is unjust to suggest that I, or any student advisers, opposed it,” he said.

Dr Nazrul also addressed criticism regarding the departure of former President Abdul Hamid from the country, who is reportedly an accused in a murder case.

“It was the responsibility of law enforcement and intelligence agencies to prevent him from leaving. This matter does not fall under the jurisdiction of my ministry,” he clarified.

He further explained that while lower court judges operate under the Law Ministry, it is not their responsibility to monitor airports or restrict international travel.
