HC questions legality of 15th Amendment

The High Court has issued a rule questioning the legality of the 15th Amendment of the constitution, which scrapped the provisions for a caretaker government.

A bench led by Justice Naima Haider and Justice Shashank Shekhar Roy issued the rule on Monday after five people, including SHUJAN (Citizens for Good Governance) Editor Badiul Alam Majumdar, filed a writ petition, reports bdnews24.com

The 15th Amendment was passed by Parliament on Jun 30, 2011 and was presented to the president for assent on Jul 3, 2011.

The amendment essentially scrapped the provisions for a caretaker government and gave constitutional recognition to Bangabandhu Sheikh Mujibur Rahman as the Father of the Nation.

In addition, the amendment increased the number of seats reserved for women from 45 to 50. Secularism and religious freedom were also re-enforced in the constitution.

The principles of nationalism, socialism, democracy, and secularism were incorporated as state principles.
