In case of death: Only heirs to get saved bank money, not nominees: HC

Staff Reporter :”Not the nominees, only the legal heirs will own saved money in the bank account of the deceased.”  The High Court in an order on Sunday declared this. A Division Bench of the HC headed by Justice Naima Haider passed the order following a writ petition.  Supreme Court lawyer MI Faruki stood in the court for the petitioner. Shahidul Haque, a former Deputy Director of the Bangladesh Bank, in a bank account in 2014 nominated his second wife to receive Tk. 30 lakh from his account after his death. After Shahidul Haque’s death, his second wife claimed to have the whole money, while the offspring of first side challenged the second wife’s claim. They filed a petition with the court in this regard. The lower court gave verdict in favour of the nominees. Later, the offspring of first side filed a writ petition with High Court. After the final hearing, the HC ordered to provide the Tk. 30 lakh of Shahidul Haque’s bank account to offspring of the first side. From now, the heirs will get deceased’s saved money in the bank account, the court said.
